Csibi Barna, address ..... Romania, hungarian-romanian citizen, passport no. ....., I’m addressing to
you with the following request:
State of facts:
At the date of 2014.06.14, during the
Annual Whitsun Pilgrimage in Csíksomlyó, near Csíkszereda, frequented
preponderently by Hungarian and Sekler ethnics from all over the world, I was
comercializing tagged T-shirts with Hungary’s old map and the traditional Hungarian turul bird, with the following text-messages:”God
bless Hungarians”, „I am Hungarian, I was born Hungarian, my nurse was singing Hungarian
above my cradle„, „Justice for Hungary”, „Give me back my mountains”, „We will
not give up, not ever”, „Hungarians were, and there will be, 100%”, and a quote of
the popular Transilvanian writer, Wass Albert: „We cannot go back as strangers at the land once was our home”.
The Harghita County Police Department
proceeded charges against me with spreading rasist, fascist and xenophobic
propaganda. During the procedure, they seized my T-shirts. This state of facts
is represented in the attached documents as well. The institute brought to my
knowledge that I am a prisoner at the bar right now, and will be sent to court.
The Romanian institute called National
Counsil against Discrimination stated a written professional opinion regarding
tha issue, in their opinion these messages crossed the right of free speach, by
texting messages of hatred by instigating to change the legal status of one of Romania’s regions.
Regarding this issue I would like to ask you to form an opinion if these T-shirt
tags have crossed the right of free speach, considering all international human
rights conventions or the Romanian authorities were the ones who have violated
these conventions.
I would like to ask you to take consideration of tha fact that the line :”God bless Hungarians” is the first
line of the Hungarian national anthem, and the line regarding Hungarian ethnic
identity, „I am Hungarian, I was born Hungarian, my nurse was singing Hungarian
above my cradle„ comes from the first line of a poem written by a popular
Hungarian poet Pósa Lajos.
I also would like you to take consideration
of the fact that justice by all meanings is the one basic value of our
civilization, and the right for justice is a fundamental human right,
regardless of nationality, as well as the right for property, and the right to
have a home in the country you are a citizen of.

Tényállás:
2014.06.14-én, a csíksomlyói búcsú
alkalmával alulírott feliratos pólókat árusítottam erre a célra bérelt
magánterületen. A pólók Nagy Magyarország ábrákat, és turulmadarat tartalmaztak,
valamint feliratokat, amik tartalmai a következők voltak: “Isten áldd meg a magyart,
Magyar vagyok, magyarnak születtem, magyar dalt dalolt a dajkám felettem, A
magyar föld nem eladó, Igazságot Magyarországnak, Adjátok vissza a hegyeinket,
Nem adjuk fel soha, Magyar volt és magyar lesz, 100%, valamint az erdélyi
íróóriás Wass Alberttől származó idézet: "Nem térhetünk vissza
idegenekként oda, ahol egyszer otthon voltunk."
A Hargita Megyei Rendőrség eljárást
indított ellenem rasszista, fasiszta, idegengyűlölő jelképek birtoklásának vádjával,
és elkobozta az említett pólókat (ez a tényállás a csatolt dokumentumban is
tényállásként van rögzítve). Amint azt hivatalosan a tudomásomra hozták, vád
alá helyeztek, és bíróság elé állítanak ezen vád alapján.
Kérném, hogy alkossanak székvéleményt, hogy a fenti szövegek mennyire merítik ki a véleménnyilvánítási jogot,
túllépik-e ezt a jogot az nemzetközi emberi jogi előírások tükrében.
Kérem külön figyelembe venni, hogy az egyik szóban forgó felirat a magyar
himnusz első sora: “Isten áldd meg
a magyart”, a másik a magyar etnikai önazonosság kifejezésére vonatkozik, Pósa
Lajos magyar költő közismert hazafias versének az első két versszaka: “Magyar
vagyok, magyarnak születtem, magyar dalt dalolt a dajkám felettem.”"
Azt is kérem figyelembe venni, hogy az igazság civilizációnk egyik alapértéke, az igazsághoz való jog nemzetiségtől függetlenül bárkit megillet, csakúgy, mint a magántulajdonhoz és a hazához való jog abban az országban, ahol állampolgárok vagyunk.
